1. General Provisions.
1.1. These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the “Terms and Conditions”) are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions of purchase of the goods and the conditions of payment for them, the procedure for delivery and return of the goods, the liability of the parties, and any other provisions related to the purchase and sale of goods in the online store “Crystal Daiva”.
1.2 By placing an order, the Buyer confirms that he/she accepts these Terms and Conditions.
1.3 The contract between the Buyer and the Seller shall be deemed to have been concluded as of the moment when the Buyer, having created a shopping cart in the online store, indicated the delivery address, selected the payment method and read the Terms and Conditions, clicks on the button “Buy”.

2. Protection of personal data.
2.1 When ordering goods in the Crystal Daiva online store, the Buyer must provide the data requested at the time of purchase: name, surname, address and e-mail address.
2.2 The Buyer is responsible for providing the correct data at the time of purchase.
2.3 When placing an order, the Buyer agrees that the personal data provided by him/her will be processed for the purpose of the order. The Buyer also agrees to the sending of information notifications to the e-mail address provided by the Buyer, which are necessary for the execution of the order.
2.4 The Buyer’s personal data may be processed for marketing purposes only if the Buyer expresses his/her own consent.
2.5 The Seller undertakes not to disclose the Buyer’s personal data to third parties, except when required by a competent public authority in cases provided for by the laws of the Republic of Lithuania or by the Buyer’s individual written consent.

3. The Buyer undertakes to pay the Seller the agreed amount for the goods ordered and to accept them.
3.1.
3.2. If the Buyer provides inaccurate, false or misleading information on the payment form, Crystal Daiva shall have the right to cancel the Buyer’s registration and delete the data.
3.2 In the event of a change in the Buyer’s information provided on the purchase form, the Buyer shall immediately inform the Seller.
3..3 The Buyer shall have the right to withdraw from the contract of sale of goods, in accordance with the provisions set out in the Rules for the Return of Goods.
3.4 By placing an order in the online store “Crystal Daiva”, the Buyer agrees to these Terms and Conditions of Sale and Purchase and undertakes to comply with them and the provisions of the legislation of the Republic of Lithuania.

4. Seller’s rights and obligations.
4.1. The Seller undertakes to provide all the conditions for the Buyer to properly use the services provided by the Crystal Daiva online shop.
4..2 If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict, suspend or terminate the Buyer’s access to the online shop immediately and without notice.
4.3 The Seller undertakes to respect the Buyer’s right to privacy with respect to the Buyer’s personal information provided in the purchase form and not to disclose such information to third parties.
4.4 The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.
4.5 The Seller may, in the event of serious circumstances, temporarily or permanently discontinue the operation of the online shop without prior notice to the Buyer.
4.6 The Seller may unilaterally change the terms and conditions of these Terms and Conditions.
4.7 If the Buyer uses the services provided by Crystal Daiva after the change of these Terms and Conditions, the Buyer shall be deemed to have accepted the change of Terms and Conditions.

5. Ordering, prices, payment procedure, terms.
5.1 The Buyer can buy online in the Online Shop 7 days a week, 24 hours a day.
5.2 Orders are accepted only through the Crystal Daiva Online Shop.
5.4 All the prices of the goods are quoted in Euro, including VAT, and in other currencies, including VAT.
5.5 The Buyer is obliged to pay for the order within two (2) calendar days from the day of the confirmation. The preparation of the parcel shall only commence upon receipt of payment for the goods.
5.6. Failure by the Buyer to make payment within 2 calendar days shall result in the cancellation of the order.

6. Delivery of the Goods.
6.1 The Buyer undertakes to specify the exact place of delivery of the Goods.
6.2 The Buyer undertakes to take delivery of the Goods himself. In the event that the Buyer is unable to accept the goods himself and the goods are delivered to the address indicated, the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong entity.
6.3. The goods shall be dispatched to the Buyer within 2 working days of the confirmation of payment.
6.4 In all cases, the Seller shall be exempt from liability for failure to meet delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Seller’s control.
6.5 The Buyer must inform the Seller immediately if the parcel is received in damaged packaging, if the parcel contains unordered goods or the wrong quantity of goods, or if the parcel is incomplete.
6.6 The Buyer must provide the Seller with photographs of the damaged parcel(s) and/or item(s) by email.

7. Quality of goods, warranties.
7.1. All details of the goods sold in the Crystal Daiva online shop are specified in the description of each item.
7.2. The units of measurement are indicated in the description of the product. The colour of the goods may vary slightly depending on the monitor used by the Buyer.
7.3. The Seller may provide an appropriate quality guarantee for individual types of goods, the specific term and other conditions of which are specified in the description of the goods.

8. Marketing and information.
8.1. The Seller may organise various promotions and offers in the Crystal Daiva online shop.
8.2. Any change or cancellation of the terms and conditions of the promotions shall be effective from the moment of the change or cancellation.
8.3 The Seller shall send notifications to the Buyer to the email address provided by the Buyer in the purchase form.
8.4 The Buyer shall send all notifications and queries to the contact details provided in the “Contact” section of the Seller’s e-shop.
8..5 The Seller shall not be liable if the Buyer does not receive the information or confirmation messages sent due to disruptions in the internet connection, disruptions in the networks of the email service providers, messages being sent to the SPAM catalogue, or due to incorrectly provided data by the Buyer.
8.6 The Buyer’s personal data may be processed for marketing purposes in accordance with the conditions set out in Clause 2.4 of the present Regulations.

9. Final Provisions.
9.1 These Terms and Conditions of Sale and Purchase of Goods have been drawn up in accordance with the laws and regulations of the Republic of Lithuania.
9.2. All disagreements arising from the execution of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
